Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and 203 Lounge LLC (“203 Lounge,” “we,” “us”). They govern your use of 203lounge.com, the member portal, your membership, and your entry to our venue in 9 Phoenix Ave, Waterbury, Connecticut 06702(together, the “Services”). By creating an account, purchasing a membership or pass, or entering the venue, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 21 years old to hold a membership or enter the venue. Valid, unexpired government-issued photo identification is required at the door on every visit, for you and for each of your guests, with no exceptions. We may refuse entry to anyone who cannot produce acceptable identification, and no refund is owed in that case.
2. Your account
You must provide accurate information when you sign up and keep it current. You are responsible for everything that happens under your account and for keeping your sign-in credentials and one-time codes confidential. Tell us right away at 203loungellc@gmail.com if you believe your account has been used without permission. One person per account. You may not create an account for someone else or transfer your account to anyone.
3. Membership tiers
We offer the following tiers. Current prices and benefits are always shown on the pricing page, which controls if it ever differs from the summary below.
- Copper — $50, single-event pass, one entry, no re-entry, solo.
- Bronze — $100/mo, unlimited access for the month, solo.
- Silver — $250/mo, unlimited access for the month, solo plus up to 3 guests.
- Gold — $500/mo, unlimited access for the month, solo plus up to 9 guests, VIP High Table included.
- Platinum — $1,000/mo, unlimited access for the month, solo plus up to 14 guests, Free VIP Couch Section.
- Diamond — $2,000/mo, unlimited access for the month, solo plus up to 19 guests, Free VIP Couch Section, Celebrity Meet & Greet tickets.
Every membership is personal to you. Guest allowances let you bring guests in with you; they do not let anyone use your membership without you present. Benefits such as VIP table and couch access are subject to availability on the night, and event tickets are subject to the terms of the specific event.
4. Billing and renewal
- Monthly tiers renew automatically each month on the date you first subscribed until you cancel. By subscribing you authorize us and our payment processor, Stripe, to charge your payment method each renewal period.
- Single-event passes (Copper) are a one-time charge for the event you select.
- Failed payments: if a renewal charge fails we will retry it. Your pass is paused until payment succeeds, and we may cancel the membership if payment is not received within 7 days.
- Price changes: we may change tier prices or benefits. For existing monthly members we will give at least 30 days notice by email before a price increase takes effect. Continuing your membership after the effective date means you accept the new price.
- Taxes: prices are in U.S. dollars and include any applicable Connecticut sales or admissions tax unless stated otherwise at checkout.
5. Cancellation and refunds
- You may cancel a monthly membership at any time in the member portal. Cancellation takes effect at the end of the current billing period. You keep full access until then. We do not pro-rate or refund partial months.
- Monthly charges are non-refundable once billed, except where required by law.
- Copper single-event passes are non-refundable. If you cannot attend, we will move your pass to another night if you ask us by email before doors open on the original night.
- If we cancel an event, Copper pass holders for that event receive a full refund to the original payment method. Monthly members are not refunded for a cancelled event, since the membership covers the whole month.
- No refund is owed for entry refused or a membership terminated under Section 8 or 9.
6. Your personal QR pass
Your pass is a personal, non-transferable digital credential tied to your account. It is cryptographically signed and expires regularly. You may not share it, screenshot it for someone else, or attempt to alter it. Presenting a pass that is not yours, or letting someone else present yours, is grounds for immediate termination of the membership without refund.
7. Guests, capacity, and entry
- Guests must arrive and be scanned in with you. Your guest count is checked against your tier allowance at the door and cannot be split across arrivals.
- You are responsible for your guests. Any conduct by a guest that would breach these Terms is treated as your breach.
- The venue has a legal capacity of 500 people. Entry is on a first-come basis subject to capacity and to any applicable fire or public safety limits, even for active members. Membership guarantees a right to enter when space is available, not a guaranteed spot on any specific night.
- We may require RSVPs, set entry windows, or close the doors early for special events, private events, or safety reasons. We will post such notices on the events page whenever practical.
- Re-entry is allowed for monthly members with a valid pass. Copper single-event passes do not allow re-entry.
8. Conduct and refusal of entry
We may refuse entry to, or remove, any person for any lawful reason, including intoxication, possession of weapons or illegal substances, harassment, violence or threats, not meeting the dress code, disorderly behavior, or breach of these Terms. Decisions of door and management staff are final on the night. Repeated or serious violations may result in termination of your membership under Section 9 and a ban from the venue.
Alcohol is served only to guests 21 and older with valid ID, and staff may decline to serve anyone at their discretion in line with Connecticut law. Please drink responsibly and plan a safe ride home.
9. Termination
You may end your membership at any time under Section 5. We may suspend or terminate your account and membership immediately, without refund, if you materially breach these Terms, including pass sharing, chargeback abuse, fraud, or conduct described in Section 8. We may also discontinue the Services or close the venue; in that case we will refund any prepaid, unused monthly period on a pro-rated basis.
10. Tables and reservations
- Gold members receive a VIP High Table, and Platinum and Diamond members receive VIP Couch Section seating, on nights they attend, subject to availability. Included seating is released if you have not checked in by the time posted for that event.
- Where we offer one-night table rentals, any active member may rent a table their tier does not already include, at the rental price shown at checkout. Rentals are charged as a one-time payment and are non-refundable except when we cancel the event.
- Table seating is a benefit for you and your guests within your tier allowance. It does not increase your guest allowance.
11. Photography and recording
The venue uses security cameras. By entering, you also acknowledge that we or our authorized photographers may photograph or record the venue and its events, and that your image may appear in that material. We may use such material to promote 203 Lounge. If you appear in a promotional image and would like it removed, email 203loungellc@gmail.com and we will work with you in good faith.
12. Assumption of risk
Nightlife venues involve crowds, loud music, low lighting, flashing lights, and alcohol service. You enter voluntarily and accept the ordinary risks of that environment. You are responsible for your personal belongings. We are not responsible for items lost, stolen, or damaged at the venue except where caused by our own negligence.
13. Disclaimers
The Site and member portal are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted or error-free. If the scanner or portal is unavailable, staff may verify your membership manually.
14. Limitation of liability
To the fullest extent permitted by Connecticut law, 203 Lounge LLC and its owners, managers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to the Services or these Terms, however caused. Our total liability to you for all claims arising out of or related to the Services in any 12-month period will not exceed the greater of (a) the amounts you paid us in that 12-month period or (b) one hundred dollars ($100). Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited by law.
15. Indemnification
You agree to indemnify and hold harmless 203 Lounge LLCand its owners, managers, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your or your guests’ breach of these Terms, violation of law, or conduct at the venue.
16. Governing law and disputes
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state courts located in the Judicial District of Waterbury, Connecticut, or the United States District Court for the District of Connecticut, and you consent to the personal jurisdiction of those courts. Before filing a claim, you agree to contact us at 203loungellc@gmail.comand give us 30 days to try to resolve it informally. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent the law allows.
17. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top shows the current version. For material changes we will notify active members by email or through the Site at least 14 days before they take effect. Your continued use of the Services after that date means you accept the updated Terms. If you do not agree, cancel your membership before the changes take effect.
18. General
- These Terms, the Privacy Policy, and any event-specific terms are the entire agreement between you and us about the Services.
- If any provision is found unenforceable, the rest remains in effect.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign these Terms or your membership. We may assign them in connection with a merger, sale, or reorganization.
